Summary
The Court held that the Election Code provision assigning a married person's residence to the place where the person's family resides does not govern a candidate's constitutional eligibility to run for office. Residency for that purpose is determined under the traditional domicile inquiry, requiring a totality-of-the-circumstances assessment of physical presence and intent to remain, and marital living arrangements may be considered but cannot alone disqualify a candidate. The Court vacated and remanded because the Commonwealth Court applied the statutory provision as a categorical bar and failed to evaluate the evidence under the proper test.
