Summary

The Court held that the statute requires the Pennsylvania State Police to provide background-check results as quickly as possible with available resources and to make a good-faith effort to staff the system sufficiently to minimize callback delays, but it does not require human research to be completed instantaneously. Sovereign immunity barred the requested permanent injunction, and mandamus could not dictate PSP's discretionary staffing and management decisions; however, declaratory relief could determine PSP's statutory duties, and the $2 fee was not refundable merely because a transaction was cancelled.
