Summary

The Supreme Court of Pennsylvania granted allowance of appeal on two issues raised by the petitioners and permitted the Pennsylvania Democratic Party to intervene, but denied allowance of appeal on the Democratic Party’s constitutional challenge to the dating requirements in the Election Code. Justice Donohue, joined by Justice McCaffery, concurred in part and dissented in part, arguing the Court should first articulate a majority rationale before deciding the constitutionality of the statutes.
