Justice Wecht concurred in the majority opinion, agreeing that the legal-services contract did not cause the county's appropriated sums to be exceeded because the complaint alleged that non-appropriated program-account funds were available to pay the firm. The concurrence separately urged the General Assembly to impose greater oversight and transparency requirements on district attorneys' use of drug-forfeiture proceeds and diversion-program funds. Justice McCaffery joined the concurrence.
