In Re: Prospect Crozer from the Delaware County Board of Assessment

Summary

The Court held that a senior judge’s simultaneous service as a tax judge and as a compensated member of a municipal board violated the constitutional prohibition on judges holding a governmental position of profit. The violation did not automatically forfeit or vacate the judge’s judicial office, but it created a constitutionally impermissible conflict of duties that presumptively prejudiced the adjudications and required the tax orders to be vacated. The Court therefore affirmed the Commonwealth Court’s result on an alternative basis and remanded for reassignment and further proceedings.
