Summary

The Supreme Court of Pennsylvania reversed the order declaring Subchapter H of SORNA unconstitutional. It held that the record did not establish a scientific consensus that adult sexual offenders pose no greater risk of committing subsequent sexual offenses than comparable nonsexual offenders, and that Subchapter H is not criminal punishment under the governing multifactor analysis. Because the statute was nonpunitive, the appellee's derivative separation-of-powers, cruel-and-unusual-punishment, and jury-trial challenges failed.
