Summary

The court held that the estate’s wrongful-death complaint stated an ordinary negligence claim against medical providers and a pharmacy whose allegedly negligent prescribing and dispensing foreseeably contributed to a patient’s impaired driving and the cyclist’s death. A plaintiff alleging physical harm need not plead a special relationship with a medical professional when the professional’s conduct allegedly created an unreasonable and foreseeable risk of that harm; the professional’s applicable standard of care remains the governing measure of reasonableness. The court affirmed the Court of Appeals, reversed the circuit court’s limited judgments, and remanded for further proceedings.
