Summary
The court held that ORS 137.370(4) authorized the Marion County sentencing court to award presentence incarceration credit for the entire 125-day period during which the relator was confined before his probation revocation sentencing. The statute applies both when confinement results from unrelated conduct before a conviction or sentence and when a person is physically held in a local jail awaiting probation-violation proceedings while serving an unrelated prison sentence. The court therefore reversed the Court of Appeals and affirmed the circuit court's mandamus judgment.
