Oregon Supreme Court
Bellshaw v. Farmers Ins. Co.
April 3, 2025373 Or. 307
Summary
The court held that an insurer satisfies the content requirement of the notice statute if and only if it uses language approved by the director, even if the approved language omits information that the statute otherwise describes. The court therefore rejected the trial court’s contrary interpretation and reversed the plaintiff’s summary judgment, but it did not decide whether Farmers’ particular notice had actually been approved. The case was remanded for further proceedings on that unresolved question.
