The Oregon Supreme Court held that ORS 144.350 does not authorize the Department of Corrections to issue an arrest and return order when a prisoner was released based on a lawful calculation of time served and later re‑arrested after a revised calculation, and therefore the plaintiff’s continued imprisonment is unlawful and he must be discharged.
