Summary

The court held that the escape clause in the post-conviction statute of limitations may apply when a petitioner's mental impairments were so severe and prolonged that the petitioner could not reasonably take the steps necessary to raise a claim within the limitations period. It also held that the petitioner's allegations of schizophrenia, medication-related impairment, and inability to understand or pursue legal remedies were sufficient to survive dismissal on the pleadings. The court therefore reversed the Court of Appeals and circuit court and remanded for further proceedings.
