North Dakota Supreme Court

Pederson v. State

January 15, 20262026 ND 1

Summary

The court held that the district court had subject matter jurisdiction over the criminal case, although it erred by treating the jurisdictional challenge as procedurally barred. It also held that the lack of a hearing on the summary-disposition motions was not error because the petitioner failed to timely reschedule one, but summary disposition of the ineffective-assistance claims was improper because the State did not seek summary disposition of those claims. The court affirmed dismissal of the remaining claims, affirmed denial of judicial disqualification, and remanded for an evidentiary hearing on ineffective assistance of counsel.
