North Dakota Supreme Court
Toppenberg v. Toppenberg
July 3, 20252025 ND 121
Summary
The court upheld the modification of Zach Toppenberg’s child support obligation because he presented sufficient evidence that his reduced income was not caused by a change in employment made to reduce support and that the existing obligation no longer conformed to the guidelines. The court nevertheless reversed the support calculation because the district court omitted $30,000 in gifts and $24,000 in unreported income from gross income. The case was remanded for recalculation of net income and the amended obligation.
