North Dakota Supreme Court
MidFirst Bank v. Young
December 4, 20252025 ND 206
Summary
The court affirmed summary judgment for MidFirst in the foreclosure action, holding that the Youngs could not challenge an assignment to which they were not parties and that MidFirst otherwise established its right to foreclose. The court also rejected the judicial-bias arguments, held that denying access to hearing recordings was an abuse of discretion but harmless, and upheld the judgment on the federal claims. It declined to reconsider the ruling allowing MidFirst's appellate brief and declined to consider transcript-accuracy disputes outside the prescribed procedure.
