Summary

The North Dakota Supreme Court affirmed the final judgment resolving mineral-title and suspended-royalty disputes. It held the appeal timely because only the later judgment adjudicated all claims without anticipating further action; upheld the interpretation of the 1964 warranty deed; rejected the alleged oral stipulation concerning the 1952 royalty deed; and affirmed the conclusion that the 1952 deed created a floating royalty. The court therefore upheld the resulting division of suspended oil and gas proceeds.
