Summary
The court held that the statutory good-faith exception in N.C.G.S. § 15A-974 applies only to evidence obtained through a substantial violation of Chapter 15A, not to evidence whose exclusion is constitutionally required. Nevertheless, the court held that exclusion of the cell-site location information was not required because the officer reasonably relied on a trial court order issued after a facially sufficient application and affidavit. The court also overruled prior precedent recognizing a categorical state constitutional exclusionary rule and adopted a state constitutional good-faith exception equivalent to the federal exception.
