Summary

The court held that Dr. Cairns was not entitled to public official immunity for conduct undertaken as a division chief and medical director at the University of North Carolina Burn Center. Those positions were not shown to have been created by statute or properly delegated authority, and the positions did not involve the exercise of sovereign power; discretionary authority alone was insufficient. The court therefore reversed the Court of Appeals and remanded for consideration of the parties' remaining arguments.
