Summary
The court held that the restaurants’ commercial property policies could cover business-income losses caused by COVID-19-related government orders that deprived them of the physical use and operation of their premises. Because “direct physical loss” was undefined and reasonably susceptible to both the insurer’s and policyholders’ interpretations, the ambiguity was construed in favor of coverage. The court reversed the Court of Appeals and remanded for further proceedings.
