Supreme Court of North Carolina
Dep't of Transp. v. Bloomsbury Ests., LLC
August 23, 2024
Summary
The Court held that summary judgment and distribution of eminent-domain compensation were proper because the trial court resolved all pleaded issues concerning title and interests in the property as of the taking date. The parties had already settled the total compensation, the validity of the development rights had been resolved in related litigation and could not be relitigated, and the appraisals presented no genuine dispute concerning allocation of the proceeds. The Court reversed the Court of Appeals.
