Summary

The Court held that the Industrial Commission properly awarded workers’ compensation benefits because competent evidence supported its findings that plaintiff’s cervical injury resulted from the workplace accident, that her delayed written notice was reasonably excused and nonprejudicial, and that she was temporarily totally disabled beginning in September 2017. The Court concluded that the Court of Appeals improperly reweighed the evidence and substituted its factual judgments for those of the Commission. The Court therefore reversed and directed reinstatement of the Commission’s opinion and award.
