Supreme Court of North Carolina
In re J.U.
June 16, 2023
Summary
The court held that the juvenile delinquency petition sufficiently invoked the trial court's subject matter jurisdiction because its factual allegations supported each element of misdemeanor sexual battery, including force, and adequately apprised the juvenile of the alleged conduct. The court rejected a hyper-technical requirement that the petition expressly recite every element or use particular words. It reversed the Court of Appeals and remanded for consideration of issues that court had not previously reached.
