Summary

The court held that the settlement agreement unambiguously permitted Melissa to designate the children’s trust as beneficiary of the life-insurance policies she maintained to secure her college-expense obligations. Applying the agreement’s plain and ordinary language, the court concluded that the term “any” included those policies and that no factual issue required a jury’s resolution. The court therefore reversed the Court of Appeals and reinstated the trial court’s summary judgment for the trust.
