Summary

The Court affirmed the sentence imposed after concluding that the trial court understood its statutory discretion under N.C.G.S. § 90-95(h)(5) and did not abuse that discretion by declining to reduce the mandatory-minimum sentence. The statute permits, but does not require, a sentencing judge to reduce a sentence after finding substantial assistance, including assistance related to other criminal cases. The trial court properly recognized assistance related to the 2016 offense, consolidated the convictions, and imposed a single sentence for the 2018 trafficking offense.
