Supreme Court of North Carolina

State v. Lamp

December 16, 2022

Summary

The court held that the evidence was insufficient to support a reasonable inference that defendant willfully submitted address information under false pretenses. Although the court rejected defendant’s interpretation that only his ultimate address had to be reported, it concluded that the State’s evidence did not establish deceptive intent and therefore reversed his conviction and the resulting habitual-felon judgment. The case was remanded for vacation of those judgments.
