Summary
The court held that defendant failed to preserve both his constitutional and statutory confrontation challenges to the admission of a suppression-hearing transcript at his probation revocation hearing. The statutory right to confrontation at such a hearing is conditional on a defendant’s request to confront or cross-examine an adverse witness, or on a proper confrontation-related objection; neither occurred here. The court therefore modified and affirmed the Court of Appeals’ decision upholding the probation revocation.
