Supreme Court of North Carolina
State v. Caballero
December 16, 2022
Summary
The court held that the deputy’s description of the principal witness’s account as “rock solid” was inadmissible because it vouched for her credibility rather than merely recounting her prior consistent statements. Nevertheless, the error did not amount to plain error because the substantial independent evidence of defendant’s guilt made it unlikely that the jury would have acquitted without the testimony. The court therefore modified and affirmed the Court of Appeals’ decision.
