Supreme Court of North Carolina

In re A.N.H.

May 6, 2022

Summary

The court vacated a termination-of-parental-rights order because several material findings were unsupported by the evidence, and the supported findings did not establish either likely future neglect or failure to make reasonable progress. Although the father had continued to produce some positive drug screens and had not completed intensive outpatient treatment, he had completed most case-plan requirements, maintained visitation, paid support, and obtained suitable housing. The court remanded for further proceedings, permitting the trial court to receive additional evidence in its discretion.
