Summary
The Court affirmed the denial of summary judgment to Officer Blackman on public official immunity grounds. Viewing the evidence in the light most favorable to Bartley, the Court held that conflicting evidence about an alleged body slam, excessively tight handcuffing, refusal to loosen the handcuffs, resulting injuries, and possible retaliation created a genuine issue of material fact as to malice. The Court also held that the interlocutory appeal was properly before it because denial of immunity affects a substantial right.
