New York Court of Appeals

People v. Fuentes

October 23, 20252025 NY Slip Op 05872

Summary

The Court of Appeals affirmed the denial of defendant's statutory speedy-trial dismissal motion. Assuming that the automatic-discovery statute required disclosure of misconduct allegations concerning an officer arising from an unrelated incident, the court held that the People disclosed the relevant allegations before filing timely certificates of compliance because the previously disclosed federal litigation materials supplied the pertinent impeachment information. The court further held that the Internal Affairs Bureau report itself did not tend to impeach the arresting officer's credibility and therefore did not invalidate the certificates of compliance or the People's trial readiness.
