The Court of Appeals held that Supreme Court failed to comply with the bail statute because it neither made an individualized determination of the defendant's flight risk nor explained the basis for that determination and its choice to remand him. The deficiency constituted an abuse of discretion, but it did not render the detention illegal so as to require discharge. The court therefore reversed and remitted for issuance of a new securing order complying with the statute.
