New York Court of Appeals
Richard Alcantara v. Anthony J. Annucci
April 25, 2024
Summary
The Court held that the Department of Corrections and Community Supervision (DOCCS) has a statutory duty to make reasonable efforts to secure community‑based employment, educational, and training opportunities for residents of the Fishkill Residential Treatment Facility, and that its wholesale refusal to do so violates Correction Law §§ 2(6) and 73(2)(3). The Court also affirmed that the internal programming at the facility meets the statutory minimum, granting summary judgment to the defendants on that issue. Procedural questions of mootness and preservation were resolved, allowing the appeal to proceed and the order to be modified and affirmed.
