Summary

The Court of Appeals held that the circumstantial-evidence standard governing the jury also applies when an intermediate appellate court conducts weight-of-the-evidence review. It nevertheless affirmed because the Appellate Division's decision did not manifestly fail to apply that standard or improperly substitute legal-sufficiency review. The court also held that the Appellate Division was not required to expressly recite the circumstantial-evidence instruction or use particular wording in its written decision.
