Summary
The New York Court of Appeals held that, under the 1986 amendment to Education Law § 1711(6), an arbitrator may order the reinstatement of teachers who were involuntarily transferred in violation of a collective bargaining agreement, and therefore affirmed the arbitration award. The Court reversed the Appellate Division’s decision that the award exceeded the arbitrator’s authority.
