New York Court of Appeals

The People of the State of New York, Respondent v. Leonard Greene, Appellant; the People of the State of New York…

November 24, 198770 N.Y.2d 860

Summary

The Court affirmed the conviction for assault in People v. Greene and reversed the reduction of the robbery conviction in People v. Bogan, remanding the latter for a factual determination. In both cases the Court held that the evidence was sufficient to find the victims suffered "physical injury" as defined by Penal Law § 10.00(9).
