Summary

The Court affirmed the conviction, holding that police questioning of the kidnapper about the victim's whereabouts before the body was found did not violate the State constitutional right to counsel because of the emergency exception, but that questioning after the body was discovered should have been suppressed. The Court further held that the admission of the post‑discovery confession was harmless error. The order of the Appellate Division was therefore affirmed.
