The Court held that a physician who writes false prescriptions, even knowing they will be used for illicit drug trafficking, is not guilty of criminal "sale" of a controlled substance under article 220 of the Penal Law, and therefore reversed the defendant's convictions for criminal sale in the third and sixth degrees.
