Summary

The New York Court of Appeals held that the State may not modify the terms of its original appropriation or otherwise limit its taking after the fact to reduce the compensation owed to a landowner. Damages for a taking are measured as of the time of the taking, regardless of any later concessions or stipulations. Accordingly, the Court reversed the Appellate Division’s order and reinstated the original award of damages.
