Summary

The New York Court of Appeals held that the exclusion clause in the casualty insurance policy applied only to the age of the driver, not to violations of the junior operator's license restrictions, and therefore granted summary judgment to the plaintiffs. The Court reversed the lower courts' denial of summary judgment and ordered judgment in favor of the plaintiffs. Justice Lehman, dissenting, would have affirmed the lower courts' denial of summary judgment.
