New York Court of Appeals

Chatham Phenix National Bank and Trust Company, Respondent v. Esther Crosney, Appellant

May 28, 1929251 N.Y. 189

Summary

The Court of Appeals held that the newer Insurance Law §55‑a does not repeal Domestic Relations Law §52 and that a creditor of a deceased husband may not reach the portion of life‑insurance proceeds exceeding $500 of premiums paid from the husband's estate when the wife is the beneficiary. Accordingly, the appellate division's order was reversed and the Special Term judgment affirmed.
