The New York Court of Appeals held that the contract between Mrs. Miller and Oliver Stanton could not be specifically performed because it failed to designate with certainty the persons who would receive the title, and because Mrs. Miller's later revocation of the deed placed in escrow rendered the deed a nullity. Accordingly, the Court reversed the General Term's order granting a new trial and denied the motion for a new trial.
