Summary

The New York Court of Appeals interpreted the "in trust" clause of fire insurance policies to cover goods held in bailment and the entire value of such goods, and held that an owner of goods may not claim under the policy unless he has adopted it before loss or received insurance proceeds; consequently the Court reversed the lower court and ordered a new trial.
