Summary

The Court of Appeals reversed the lower court, holding that assignments made by the president and cashier of the Morris Canal and Banking Company without director authority were void, that a judicial sale by receivers appointed under New Jersey law conveys good title despite champerty statutes, and that foreign statutory assignments under a bankrupt law have no force in New York. The plaintiff therefore obtained valid title to the debt from the receivers' assignment.
