Summary

The New Mexico Supreme Court held that the defendants satisfy all statutory requirements for release pending appeal under NMSA 31-11-1(C) and therefore are entitled to such release. The Court reversed the Court of Appeals, which had affirmed the district court's denial of release, and remanded for the district court to order release on conditions no greater than those imposed pretrial.
