The Supreme Court of New Jersey held that the new rule in State v. Cain and State v. Simms limiting drug expert testimony to prospective cases did not apply retroactively to Covil’s trial, so the expert testimony was proper, and that the admission of Covil’s notice of motion for a writ of replevin and certification did not violate his constitutional rights; consequently the Court reversed the Appellate Division and reinstated Covil’s conviction.
