Supreme Court of New Jersey

Rosa Acuna Administratrix Ad Prosequendum of the Estate of Andres Acuna, Deceased Infant of Rosa Acuna, General…

September 12, 2007192 N.J. 399

Summary

The New Jersey Supreme Court held that under the common law doctrine of informed consent a physician is not required to tell a pregnant woman that a six‑ to eight‑week embryo is an existing human being or that abortion kills a living human being, and therefore dismissed the plaintiff's lack‑of‑informed‑consent and emotional‑distress claims. The Court reversed the Appellate Division’s reinstatement of those claims.
