The Supreme Court of New Jersey affirmed Winston Roach's convictions, holding that the prosecutor's conflicting theories and arguments did not constitute prosecutorial misconduct warranting reversal, that Roach's confession was voluntary and admissible, and that the jury instructions on accomplice liability were proper. The Court, however, remanded the case for further determination of whether the disparity between Roach's sentence and that of co-defendant Jackson was unjustifiable. Justice Coleman, concurring in part and dissenting in part, argued against the remand.
