Supreme Court of New Jersey
Charles Shammas, Also Known as Fathalla Shamas, Plaintiff-Appellant v. Mary Shammas, Defendant. William W. Evans…
April 28, 19529 N.J. 321
Summary
The New Jersey Supreme Court reversed the Appellate Division's order vacating a divorce decree on the ground of alleged perjurious testimony. It held that only parties to the original proceeding, or their legal representatives, have standing to attack a final judgment, and that perjury alone is insufficient to constitute fraud upon the court for relief under Rule 3:60-2. Accordingly, the decree was reinstated.
