Summary

The court held that the statute governing rights during court-ordered examinations is unconstitutional to the extent it conflicts with the procedural requirements for civil-discovery examinations. Applying the governing civil-procedure rule, the court upheld disclosure of raw testing data subject to a protective order but invalidated the audio-recording and interpreter conditions for lack of adequate good cause or evidentiary support. The petition was therefore granted in part, with instructions to modify the examination conditions.
