Summary
The Nevada Supreme Court affirmed the denial of Holguin’s workers’ compensation claim for a disabling occupational lung disease caused by COVID-19. The court held that the statutory presumption that a qualifying employee’s lung disease arose out of and in the course of employment does not eliminate the separate requirement to prove that the disease resulted from exposure to specified substances. Because Holguin did not show that his COVID-19 resulted from such exposure, his claim was properly denied.
