Nevada Supreme Court
Valley Health Sys., LLC v. Murray
March 14, 2024140 Nev. Adv. Op. No. 14
Summary
The Nevada Supreme Court held that a hospital does not owe a fiduciary duty to a patient in connection with medical treatment, so the medical-negligence damages were subject to statutory caps and the hospital's 65-percent several share of fault. It reversed the punitive-damages award, vacated prejudgment interest for recalculation solely as to past damages, and affirmed the attorney-fee and cost awards. The judgment was therefore affirmed in part, reversed in part, vacated in part, and remanded.
